MEDIA RELEASE RELIANCE POWER WINS APPEAL AGAINST CERC ORDER ON SASAN UMPP APPELLATE TRIBUNAL (APTEL) SETS ASIDE THE CERC ORDER REGARDING COMMENCEMENT OF COMMERCIAL OPERATION OF FIRST UNIT OF SASAN UMPP ON MARCH 31, 2013 CERC ASKED TO HEAR AFRESH WRLDC PETITION APTEL ALSO DIRECTS CERC TO FIRST DECIDE ON MAINTAINABILITY OF WRLDC PETITION CERC TO HEAR WITHOUT BEING INFLUENCED BY ITS EARLIER FINDINGS

MUMBAI August 13, 2013 Reliance Power today said that the Appellate Tribunal for Electricity (APTEL) pronounced judgment allowing Sasan Power's appeal against Central Electricity Regulatory Commission (CERC) order dated 20.06.2013 on Commercial Operation Date (COD) of Sasan UMPP. APTEL has set side CERC's impugned order and has directed CERC to decide the matter afresh including the issue of maintainability raised by Sasan Power Limited (SPL) without being influenced by its earlier findings. SPL is a wholly owned subsidiary of Reliance Power implementing Sasan UMPP.
Aggrieved by CERC's order, which had set aside the certificate issued by Independent Engineer's (IE) for declaration of COD of Sasan UMPP's first 660 MW Unit based on petition filed by Western Region Load Dispatch Centre (WRLDC), SPL filed appeal before the APTEL on grounds that CERC's order is violative of principles of natural justice and is not tenable in law.
APTEL has upheld SPL's arguments and has quashed CERC's order on the following grounds
(i) CERC's order is a clear violation of principles of natural justice

(ii) Despite SPL filing submissions only on maintainability and clearly reserving its right to file a
detailed reply on merits after admission, CERC hurriedly decided the matter at admission stage itself without deciding the issue on maintainability and without giving an opportunity to SPL of being heard on merits of the case.
(iii) CERC did not provide any explanation about the urgency of disposing of the petition at the admission stage itself.
APTEL has remanded the matter back to CERC to decide the matter afresh including the issue of maintainability raised by SPL and decide the matter without being influenced by its earlier findings after hearing SPL and other concerned parties.
The 3,960 MW Sasan UMPP, the world's largest integrated power and coal mining project was commissioned on March 30, 2013. The electricity generated from the project will be available 14 distribution companies across seven States at a low cost benefiting an estimated 35 crore people.
